Acceptable Use Policy
Good--Games.Net reserves the right to change this Policy any time,
so please, check this page at least once every 30 days or when in
doubt. Update to this policy will be announced at Good--Games.Net
forums. Good--Games.Net strives to provide the best possible
service to all our customers, but we will not tolerate any unlawful
activity or abuse on our servers. We respect freedom of speech and
expression unless it is harmful to others. These brief guidelines
are imposed to protect you, other Good--Games.Net customers and
Good--Games.Net against such harm. Signing up with
Good--Games.Net and/or any of its services shows your agreement
with our TOS [Terms of Service] and AUP [Acceptable Use Policy].
Should the AUP or TOS be changed for any reason, the users will have
30 days to change their site to abide by the regulations set forth
in AUP and TOS. The information in the AUP is in conformity with the
information in the TOS. Should any conflict rise between the two
documents, the information and rules set forth in the TOS will
supersede any other information.
Payment Policies, Fees, Refunds and Terms of Agreement:
Full payment is required before any Good--Games.Net service is
rendered, which includes renewals. All payment-due notices will be
sent by electronic mail. No bills or invoices will be sent by postal
mail or fax. Payments must be paid through one of the methods listed
on our payment page. Prepayment is due each anniversary (one month,
three month, six month, one year, two years, or other duration if
agreed upon in advance) following the date the account was
established. Billing will continue until you cancel your hosting
account. You may cancel at anytime. As a policy, we do not offer
credits or refunds for hosting time already expended.
You can update your billing information anytime by contacting
Good--Games.Net via the official support channels. Failure to
update your credit card, whenever a change is necessary, with the
latest information could result in a billing for your
Good--Games.Net service being unsuccessful, which in turn
may result in the suspension or termination of your service's] with
Good--Games.Net .
We do give refunds for full months unused, should you want to cancel
a prepaid service. If you decide to cancel after prepayment, you
will not receive a refund for the current month in use (We do not
give partial months refunds). If you have prepaid and received a
multi-month discount, upon cancellation we will figure the refund
retroactively withdrawing the discount back to the start date of the
contract. This will result in paying full-undiscounted price for the
months used and refunding the balance. This only applies to
cancellation by the client. If cancellation is done by
Good--Games.Net due to restrictions violation, there will be no
refund. Good--Games.Net will only allow for the discount if
cancellation is not the fault of the client, as determined by
Good--Games.Net . All monetary transactions are in $US dollars.
Additional features can be added at any time. Monthly feature prices
are not prorated. Good--Games.Net reserves the right to change
prices at any time. It is the sole discretion of Good--Games.Net
to provide refunds, whether full or partial, for duration of time
after the first 30 days of your first initial payment.
Account Cancellation:
You may cancel at anytime. Phone requests will not constitute
acceptance of any cancellation. To cancel your account, please
contact Customer Service at cs@ Good--Games.Net . Notification of
cancellation must be received at least five business days prior to
your cycle date, with the cycle date being the day of the month you
sign up, in order to avoid charges in full for the next cycle. It is
the Clients Responsibility to secure email confirmation from
Good--Games.Net that account has been canceled. If the
client has not yet received email confirmation of account
cancellation, then the account remains active, and you will continue
to be invoiced.
If Client has a balance due at the time of canceled, this
balance must be paid in full. canceled does not absolve
Client of any outstanding financial obligations.
canceled credit card payment for your Good--Games.Net
service[s] requires you to contact Good--Games.Net . PayPal
payments can be canceled by contacting Good--Games.Net , or
via your Paypal.com account interface. Note that, canceling any
payment in any form, whether via credit card, PayPal, or any other
agreed form of payment, automatically results in the termination of
your Good--Games.Net service[s]. You must contact
Good--Games.Net prior to canceling any account if you wish to
retain your Good--Games.Net services in any way.
To cancel a hosting plan, simply contact Good--Games.Net with
your request. Your initial billing routine, whether PayPal, credit
card, or any method of agreed payment, will also be canceled.
If you have signed up for any additional services such as Domain
registration, or extra disk space, which you would like to be
cancelled also, you must let Good--Games.Net know of these
acquired services; otherwise, they may not get automatically
canceled from future billing. If such a future billing occurs,
simply contact Good--Games.Net and you will be reimbursed
[refunded] for any excessive amount charged after you cancel your
services with Good--Games.Net
Payment Policy:
If billing has failed for a client after a continuous 7 days, and
no arrangement has been made by the customer beforehand, the account
will be suspended for 7 days [starting from the 7th day of the
billing failure], and on the 7th day of suspension [which would be
the 14th day of billing not working for that client], if the
customer still has not contacted Good--Games.Net , the account will
be deleted from Good--Games.Net servers and all information stored
[files, emails, etc] related to that account will be removed
completely. In such a case, any Good--Games.Net services offered
to a client who has not paid for any Good--Games.Net services free
due for 14 days, will be suspended/terminated.
Domain Names Information and Payments summary:
Domain name payments are always to be made in advance. Domain name
fees are non-refundable. By signing up with Good--Games.Net
services or using any Good--Games.Net service, you agree that you
will not claim a refund for the price you paid for a domain name
that Good--Games.Net has registered for you. Good--Games.Net
cannot offer any refunds for registered domain names.
Domain name transfer fees from other registrars to
Good--Games.Net [any current registrar that Good--Games.Net
prefers to use at the time of signing up for Good--Games.Net
Domain services], whether or not included with Hosting Services, are
also non-refundable.
Domain names fees and information, whether
renewal/transfer/registration or anything related, will always be
updated with the latest pricing and information at http://www.
Good--Games.Net . It is advised and recommended for all
Good--Games.Net Domain Services Users/Customers to bookmark that
page and use it as a reference to be aware of the latest news about
pricing and how Good--Games.Net manages domain names. The
information on the domains page will be in conformity with the TOS;
however, if there is any conflict with any of the information at
either pages, the information and rules mentioned in the TOS will
supersede any other information.
Domain name prices are from year to year, or combination of years
[multiple years]; they will not be charged from month to month.
Domain names registered through Good--Games.Net Domain Services
can be transferred to any other registrar, at any time, for no
additional fee. However, if a domain is transferred away from
Good--Games.Net Domain Services, it will not avail the then pricing
structure maintained by Good--Games.Net Domain Services; instead,
you will be charged by the new registrar, to which you have
transferred the domain to, independent of Good--Games.Net .
Good--Games.Net will then not be responsible for any actions,
charges, or any situations resulting from the actions of the other
registrar/party which could affect your domain names in any way.
Good--Games.Net is not responsible for the action of any
third-party services, and your continuing use of any
Good--Games.Net services, including Good--Games.Net hosting
services shows your consent and agreement to this rule.
Indemnification Policy:
You agree to use all Good--Games.Net services and facilities at
your own risk. Good--Games.Net specifically disclaims all
warranties of merchantability and fitness for a particular purpose.
In no event shall Good--Games.Net be liable for any loss, or loss
of data, or other commercial damage, including but not limited to
special, incidental, consequential or other damages. Customer agrees
that it shall defend, indemnify, save and hold Good--Games.Net
harmless from any and all demands, liabilities, losses, costs and
claims, including reasonable attorneys fees asserted against
Good--Games.Net , its agents, its customers, officers and employees,
that may arise or result from any service provided or performed or
agreed to be performed or any product sold by customer, its
agents, employees or assigns. Customer agrees to defend, indemnify
and hold harmless Good--Games.Net against liabilities arising out
of:
(1) Any injury to person or property caused by any products sold
or otherwise distributed in connection with Good--Games.Net s
server;
(2) any material supplied by customer infringing or allegedly
infringing on the proprietary rights of a third party;
(3) copyright infringement and
(4) any defective products sold to customer from Good--Games.Net s
server.
Good--Games.Net shall be the sole judge of what violates this
Policy.
SPAM Policy:
Good--Games.Net is committed to a zero-tolerance, anti-spamming
policy. Under this policy, we prohibit Spam, or any unsolicited
commercial email, from being sent either: Over the Good--Games.Net
network, by customers or any other users of the Good--Games.Net
network (including customers); AND/OR over ANY network- if the
message sent advertises or mentions a site hosted on the
Good--Games.Net server.
We react quickly and seriously to violations, and we further reserve
the right to terminate the services, without prior notice, of any
customer disregarding this policy. Sending unsolicited commercial
email (a.k.a. "spam"), cross-posting messages to a large number of
usenet groups, posting obscene or threatening messages while using
or referring to an Good--Games.Net email address or web site URL
is prohibited. The use of Good--Games.Net servers as a mail drop
for responses to activities described above is also prohibited.
Accounts canceled due to spam will be billed a "clean up" fee of
$1000.00
If you have any complaints or comments regarding Spam on our
network, please direct them via email to abuse@Good--Games.Net
Content Policy:
All services provided by Good--Games.Net may be used for lawful
purposes only. Transmission, storage, or presentation of any
information, data or material in violation of any United States
Federal, State or City law is prohibited. This includes, but is not
limited to: copyrighted material, trademark, intellectual property,
material we judge to be threatening or obscene, or material
protected by trade secret and other statute without proper
authorization. The subscriber agrees to indemnify and hold harmless
Good--Games.Net from any claims resulting from the use of the
service which damages the subscriber or any other party.
Pornography and sex-related merchandising is prohibited on all
Good--Games.Net servers. This includes sites that may infer sexual
content, or links to adult content elsewhere. Good--Games.Net will
be the sole arbiter in determining violations of this provision.
Also prohibited are sites that promote any illegal activity or
present content that may be damaging to Good--Games.Net servers or
any other server on the internet. Links to such materials are also
prohibited.
Examples of unacceptable content or links, but not limited to the
following, are:
Pirated software
Hacker programs or archives
Warez sites
Good--Games.Net does not host sites of its competitors or web
pages promoting sites of its competitors. Any illegal
activity, including adult content, links to adult content web sites,
spamming or hacking will result in your site being shut down
and all your files deleted without warning, and your
Good--Games.Net services being terminated. Good--Games.Net will
be the sole arbiter as to what constitutes a violation of this
provision.
Email Policy:
Good--Games.Net may not be the source, intermediary, or
destination address involved in the transmission of any unsolicited
email, email bombs, hate email, or any mass email. Your email
account may not be referenced as originator, intermediary, or
reply-to address of such email. We consider mass email any email
message sent to more than 25 email addresses or more than 10 news
groups.
CGI Scripts Policy:
Each Good--Games.Net hosting account comes with its own cgi-bin.
You are free to use any CGI scripts you wish, except for chat rooms
or similar scripts. We reserve the right to disable any CGI script
that affects normal server operation or service to other
Good--Games.Net customers. You will be notified in 24 hours about
the offending cgi script[s].
Banned Scripts Policy:
Good--Games.Net does not allow the use of some scripts on its
servers due to resource issues. Listed below are the scripts that
cannot be used:
UltimateBBS (all versions)
Ikonboard (all versions)
IRC Egg Drops
Proxy Servers
Safelists
nph-proxy
The Anonymizer
Anyone using any of the scripts in the above list will be
notified and asked to remove the script. Second violation of these
terms will be dealt with according to Good--Games.Net s discretion.
Chat Policy:
Good--Games.Net does not allow chat rooms. You can however link
your site to a chat provider. Some examples of chat providers are:
www.humanclick.com, www.liveperson.com, and
www.livehumanhelp.com. We
do allow chat scripts that are already installed via Cpanel
SSL Policy:
Good--Games.Net provides shared SSL, free of charge, for all
servers and all accounts, unless otherwise agreed or noted. SSL
service is provided as is, without any warranty or guarantee.
Good--Games.Net cannot be held responsible for any losses
that may occur while using ssl.
Traffic Policy:
Good--Games.Net allows for very generous traffic, and most sites
never exceed 500MB per month, unless they offer shareware, sound,
video, image and multimedia archives, are mirror sites or any site
whose primary purpose is file distribution. Good--Games.Net
customers are discouraged from storing any files that cause
excessive traffic on Good--Games.Net servers. Please contact
Good--Games.Net Technical Support team for more information. Again,
most of the sites do not fall into this category and never reach our
traffic limits.
We reserve the right to refuse service to anyone for any reason not
prohibited by law. Also we reserve the right to terminate service to
any customer for any reason not prohibited by law.
Any deliberate attempt to cause damage to Good--Games.Net or any
other Internet servers will result in immediate account deactivation
without prior notice. No refund is given in this case.
All account plans come with a predetermined amount of traffic
allowance. We monitor all accounts and can bill extra for each gig
of traffic exceeded. You will NOT be charged for transfer that you
use beyond our generous data transfer limits without prior
notification. You can monitor your transfer at anytime in your
Control Panel.
Backups:
Full backups are made weekly, and backups of new/changed data
made nightly. No guarantees are made of any kind, either expressed
or implied, as to the integrity of these backups. Backups are made
for server restoration purposes only. It is the clients'
responsibility to maintain local copies of their web content and
information. The "Backup Manager" is included in each hosting plan
and client can use this tool to back up their files. If loss of data
occurs due to an error of Good--Games.Net , we will attempt to
recover the date for no charge to the client. If data loss occurs
due to an error on behalf of the client, in securing their account
or by an action of the client, Good--Games.Net will attempt to
recover the data from the most recent archive for a $60.00 fee.
Notice:
The AUP is a detailed information agreement that lists what can
and cannot be done with your Good--Games.Net hosting account,
rules of using Good--Games.Net support, how payments are
processed, etc. The AUP may change frequently and more often than
the TOS.
Any changes in the AUP go into effect right away; on the other
hand, any changes to the TOS will go into effect within 30 days of
the change. Customers will be notified of any changes to the TOS,
via forums or any "current" official means of communication, one [1]
day prior to the start of those 30 days. It is the customers
responsibility, even if no announcement has been made about it, to
keep themselves up to date with the latest TOS and AUP.
If you continue using any of Good--Games.Net services, after
either AUP or TOS has been changed, or both of them changed, you are
expressing your consent and agreeing with abiding by the TOS and
AUP, and to follow any rules set within the AUP and TOS. You also
agree then, after using any of Good--Games.Net services when
either the TOS or the AUP, or both, have been changed, that your use
of Good--Games.Net will not violate the then AUP or TOS. Your
continuous use of any of Good--Games.Net services shows your
agreement to abide by the TOS and AUP.
